PO-PO, driving while Black in Forest Park [FP]

Thursday I watched a Forest Park police officer arrest Clarence Davis, a Black motorists at approximately 12:45 PM. The arrest happened on Randolph ½ block east of Des Plaines, 50 feet from Davis’ destination, the bridal gown consignment shop. He was going there to pick-up a print order.

At the time a police officer told me that Davis was initially stopped for a bad brake light. The incident report says Davis was initially stopped for not wearing a seatbelt. Davis was arrested because his both the vehicle’s license and his driver’s license were suspended. The vehicle belonged to Davis’ employer; Davis says he was unaware of the vehicle’s registration being suspended.

During the arrest the officer used a taser on Davis multiple times. While pressed against his car Davis told me that the officer had made Davis "shit" himself. Davis requested I tell the owner of the consignment shop he was being arrested.

The Forest Park Police Department held Davis until approximately 5 PM. He was not allowed to wash himself and sat in his own feces for hours. His pants and shoes were removed and he was given paper pants to wear.

When Davis was released he did not receive his pants or shoes back. He had to walk barefoot across Forest Park to get assistance. When Davis asked to file a complaint the officer refused to explain the complaint procedure to Davis.

The officers who wrote the incident report fabricated at least part the report. They claim that Davis deliberately defecated to make managing him more difficult.

Based on the police providing two different reasons for initially stopping Davis—both rather flimsy reasons to stop a vehicle anyway—I suspect the incident is a textbook case of racial profiling.

The fact that a simple traffic arrest escalated into a violent situation reflects poorly on the training of the officer involved.

Forcing an offender to sit for hours in his own feces is simply a human rights violation. Davis wasn’t intoxicated and seemed pretty calm for a guy who was getting shocked with a taser. Destroying his clothing and forcing him to walk barefoot is reprehensible.

  • Yeah, yeah, yeah, the officer "told me", the report "says", and these are just all allegations the police make up. What the poor victim motorist says is fact, though, right? You say you saw this arrest take place, yet I find it interesting that you don't describe for us what precipitated him being tasered. Selective memory? Report only what's convenient to further your agenda? By the way, I thought it was the police's job to stop people for traffic and equipment violations such as you described. And what difference does it make that he almost made it to his destination? Now he deserves a free pass? You also report that he had to sit in his own feces for hours, but yet he left the station in a paper suit. Sounds just a little contradictory to me. I really wish you were police chief. You're just so full of actual substantive reason and ideas. You HAVE given us some thought on how police should work effectively, right?   • What's your issue Carl? Should we all be allowed to drive with a suspended license or didn't he know he had a suspended license (HOW WOULD THAT HAPPEN)? Should we allowed to drive without seatbelts? Should we be allowed to drive with suspended plates? Broken taillights? Why should we bother to get a license or insurance? Especially if we're black. We'll get stopped and cry foul. GIVE ME A BREAK.

    Sounds like they had enough reasons to stop him. And were you there to witness this? Hiding in the back of the van perhaps.

  • Stop and ticketed sure, tasered - No. The police chief needs to examine their policy on tasering and set limits. If he doesn't do it, then the state certainly will. A taser bill was proposed and will be heard in December of this year. Hopefully the results will help officers who can't help themselves understand the effect of tasering and set limits; in order to protect the public.

  • Meantime do not give out the details, do not talk to the officer, do not give out any witness information. Do not expose pertinent information to the press (which you are) because that will backfire when FPPD counterattacks with a written report full of lies. The FPPD will use intimidation tactics and may misquote witnesses. Not worth it.

    BTB, NAACP and other groups are not interested in this kind of case. Why, because your friend did not die and/or was not hospitalized. So its a double edged sword.

  • We do not live in a police state. This is not Russia. If a man is driving without a license, that is a valid reason to cite an individual. However, the police have a responsibility to enforce laws, not act like criminals. Police are and should be held to a higher standard and they should be man enough to rise above a "tuning" up with the latest high voltage technology. Human beings have rights regardless of their driving status. When they make mistakes, there are appropriate ways to punish. Humiliation, making one sit in their own feces, turning human beings out into the street without shoes? This is brutality, not law enforcement. Anyone that thinks this is acceptable behavior by people that take oaths of office is not fit to wear a uniform and badge. If this is the good work that you believe the FPPD should keep up, you have lost your soul.

  • To all of you that have posted negative opinions of the incident , let me say to you that I also was a witness to the events as was Carl. Mr. Davis was pulled over for a broken tail light. He was never cited for a broken tail light that was the excuse that was used to furthur question him. He was not the owner of the vehicle so he had no idea of the registration being suspended. He howeever was guilty of the suspended license of which he accepts responsibility for. He was not resisting arrest he had both hands on the roof of the car as instructed. 8 additional police cars arrive on the scene. Only one other officer assisted in the actual arrest. There was no reason for him to be tazered he was severly outnumbered with several witness there. He did lose control of his bowels once tazered and was forced to sit in a holding cell for appox. 5 hours. Not being allowed to clean himself. Only to wash his hands for fingerprinting. He was forced to sit in the first cell,He was put on display for all to make comments about the odor. He was released around 5 p.m. He was unable to make phone calls. He was issued a pair of paper pants sz. large this man is 6'0 ft 240. the pants were ripped from the knee to the crotch. He was forced to leave with a coat, paper pants, NO SHOES IT WAS 31 DEGREES THAT NIGHT. So for all of you that have formed a the police is always right opinion imagine this happening to you. WE TREAT ANIMALS BETTER THAN THIS!!! POWS HAVE BETTER TREATMENT !!!! For those of you that do not beleieve racial profiling exists, I suggest you take a drive through an inner-city neighborhood (this is if you are a white male) Odds are 9 out of 10 you will be pulled over no matter the reason. You will get pulled over by a black cop who has profiled you . The Profile : Looking to score drugs or pick up a prostitute. I bet your attitude would severly change .
    Just because someone signed a bill making it illegal does not mean that it does not happen.

  • The obvious, how can you put out such an obviously biased post such as this, and pretend like you're just after the truth? You never indicated what precipitated this man being tased, why? You say he sat in his feces for hours, yet also report he was issued a paper suit. Which is it? Why do you take this man at his word, but never the police? Are you telling me that it is not legitimate for police to stop someone who has a broken taillight and/or not wearing a seatbelt? Are you telling me this man should have been let go because he almost made it to his destination? A lot of questions, sorry, but mostly, I'd like to know what you would do if you were a cop for one day. I ask this because you have spread a lot of self-righteous opinions about police and how they operate. I guess I'd like to hear you tell me how you'd handle typical police situations, from the mundane traffic violator to violent confrontations with police fighters. If you know of better ways to conduct yourself as an officer, please explain.

    How many middle-aged "White" women driving expensive cars get pulled over for seat belt violations? Cracked windshields? Defective taillights? Etc?

    The FPPD is in a bit of a bind on this one b/c the reason for the initial stop was one thing at the scene and another in the police report.

  • Police station jails are not the Hilton, most do not come equipped with full showers and facilities. Allowing this guy to wipe himself up and be given something else to wear might be the best they can do.
    Do YOU know how many old ladies in nice cars get stopped for equipment violations? Your biased and/or paranoid view on police tells me that you only focus on the negative. This is quite evident in the fact that you started a conversation TWICE on Jose Montoya, but never mentioned Tom Wood, a Maywood officer brutaly slain in the line of duty. Any explanation for why you never reported that?

  • Carl, sorry but gee if FPPD is profiling guess what, it works. If I sat on my front porch and did a non-scientific study of cars driving past my house that use seatbelts (and I have) most of the cars that are breaking the law have non-white drivers. I don't know for a fact but I would also bet that some of them are driving without a license or insurance. Profiling, yes, probably true yes. If you're non-white and are driving without a license and (even if you don't know it) a car with suspended plates and a burned out taillight and no seatbelt, then you like to gamble. Be prepared to be stopped!

    Theresa Kelly is the ultimate disgrace. She refuses to be honest about her dealings,instead she blames Welch for all her problems. Why can't the Forest Park review do a story about this? Why can't the Proviso Probe do a story about Kelly's refusal to discuss these allegations about herself and her actions. If I was Yarbrough and Flowers I would stand far away as possible from her, and I would tell her for her sake to go to the media and discuss her allegations to prove them wrong, if they are wrong.
    Yarbrough should also demand that she do this, because as you recently saw what happen to speaker Hasert about the Mark Foley inicident with pages, his mistake was not being proactive and immediatley report Foley and ask for an investigation.Yarbrough be careful, don't protect her if she is wrong, and also demand for her to speak up and prove these allegations wrong, if not it will linger in voters minds, and will also effect you, for your poor judgment in not exposing corruption within your organization.

  • When I was voting yesterday, there was a black guy hanging out and talking with the poll workers for a long time while his eligibility was being figured out (he’d been out of the country or something). When he finally left, I heard several of the poll workers remark, loudly and conspicuously, what a nice young man he was (he was 27; I’d overheard his birthdate as he was giving it to them), and how rare that was these days. Would they have remarked the same way about me? Of course not — it would have been absurd and weird. It’s not-so-subtle shit like this that I notice from time to time that makes me realize that subtle signs of racism are very prevalent in the US to this day.
    On top of that, the legacy of Jim-Crow laws (which are not very far in the past) and slavery are very difficult to shake off for reasons that are no less real for being complicated.
    Statements like “those people should stop complaining and do something about their situation” are roughly equivalent to “I refuse to look into this situation and try to figure out what might be going on.”

    It's so sad...one would think that a 37 year old man could find inner peace within himself instead of being jealous of the accomplishments of another individual. It's especially disturbing to see this type of obsessive behavior aimed at a senior citizen.

    What do you think, has Chris "The Proviso Insider" Welch officially lost his mind? What does Welch expect to gain from physically attacking a senior citizen? Based on his maniacal postings and apparent stalking, should Theresa Kelly put out a restraining order on Chris "The Proviso Insider" Welch? Is this the type of behavior attributed to a normal 37 year old man?

  • Meantime do not give out the details, do not talk to the officer, do not give out any witness information. Do not expose pertinent information to the press (which you are) because that will backfire when FPPD counterattacks with a written report full of lies. The FPPD will use intimidation tactics and may misquote witnesses. Not worth it.

  • Fortunately, sueing is the only way to get these out of control officers compliant and to understand the law. Its amazing how much Officer Friendly really doesn't know regarding the LAW. However, they will never tell you that; they'll lie, use intimidation tactics or talk like they are your best friends to catch you off guard. They will misquote you and jump to conclusions mostly way off left base. Scare tactics from residents who are not looking forward to another civil lawsuit. SUE, SUE, SUE. That is the only way you can stop this type of behavior.

    Posters here call it liberal, well laws were enacted to protect unfair treatment of individuals. This is way over the top of inhumane treatment.

  • I happen to be an officer in the proviso community and I work my ass off every day I'm at work. Sometimes people fight with the police sometimes they get hurt alot of the time the officer gets hurt. You all think that we wake up and say hey i'm going to beat the living crap out of some poor citizen today, and thats just not the way it is. There are alot of GOOD officers that work all over the proviso area, so stop bashing your police.

    What do you want the police to do when some idiot starts resisting arrest or fights with the police. I have a wife and kids and I'm going to do everything in my power to make sure I go home safe to them everyday.

    Now let's not get excited. I said "NOT ALL" not EVERY police officer. If what I wrote before offends you it's because the truth hurts. You know as well as I do what really goes on in some departments! It's not fair that alot of citizens have to be scared of gangbangers and in some Villages at the same time the police!!

    For "us guys" I really don't care for Nyberg that much either yes most of it is nonsense but I don't think so in this case. A second witness spoke on 11/7 7:16 pm with some pretty detailed statements. Plus I know for a fact this kind of thing happens more then the public is made aware of but not always to this extreme. As I said before we are not in fantasy land. By the way you seem like a law enforcement type how would you have handled this one? Oh, and if you are so intrested in the Woods case why don't you do some investigating and find out for us!

    I'd like to answer how I'd handle it, but since Carl leaves out some obvious details of what really happened, I can't say for sure. I'm not in fantasyland, I know police brutality exists, I know cops aren't all perfect. I just would like to see a fair debate, and Carl doesn't present one. My point with Officer Wood is that Carl conspicuously avoided the incident. He won't address the murder, and now he won't address why he neglected to report it. The reasons seem fairly clear to me. He doesn't want to publicize anything that might give the police credit or sympathy.
