DEFAM, The verdict: It’s a Mistake [Esparza]

The Esparza v. Moore trial ended in a mistrial. Earlier entry one and two.

Some unauthorized documents were mixed into the evidence the jury was given to examine. According to Bob Habib, Esparza’s attorney, the documents were his. He speculated that after the judge and attorneys agreed on the documents to give the jury the documents were set on the mantle while the attorneys waited for a page of the jury instructions to be delivered. When the pile was given to the deputy it included an extra folder that was probably next to the authorized documents on the mantle.

The indications are that the jury was much more sympathetic with Esparza than the defense. The jury foreman spoke to the junior defense attorney. He chastised her in a sharp tone of voice. He told her a few times that the defense attorneys would “parse words and insult the jury’s intelligence”.

Later Sue Esparza, a daughter of Paul, said the foreman told her that the jury was unanimous as to defendants Moore and Sharp. They were not in agreement on Abdullah. Abdullah who was only linked to the flyer by his post office box number and the fact he did communications work for Moore on the campaign in question.

I was tempted to speculate that Eugene Moore had once again avoided the consequences of his actions. But it seems likely that the trial will happen before the March 21 primary. If it does, Moore will have to take another two weeks out of his schedule to be in court.

State Farm, Moore’s insurer, would seem to be the big loser. I expect the attorney to bill for another 60 hours (at least). At $180 per hour (the Chris Welch rate) that’s another $10,800 on an effort that is probably going to lose.

Unfortunately for State Farm they are insuring a client who would rather lose and say the jury got it wrong than he would to admit to any wrongdoing.

  • Well this really SUCKS! What a waste. Do ya think it was a on purpose?

  • Who do ya think yawls kidin? Sleeze vs. sleeze.

By Anonymous tell it to yawls mama, at 7:56 PM, January 27, 2006

  • IMO it was an honest mistake.

Without any intel on how the jury saw the situation, it's not obvious who would benefit from a mistrial.

A mistrial isn't exactly a good deal for Moore. He'll have to take two weeks out of his life to do it again, probably before the primary.

Your daughter was also there today. Let's not forget to tell Chris that too!

If Eugene Moore needs a character witness for the trial contact me. Carl has my email address. BABY SISTER

By Anonymous szainelli, at 7:03 PM, January 28, 2006

  • Aunt Sue,

You did NOT have written persmission! you had a fucking e-mail! anyone could have written that! SO FUCK YOU! My mother would not want her things to go to YOU of all people! She never had nice things to say about you so talk all the shit you want! Most of my family can attest to that! In all my life i have seen you probably 4 times total! The most recent was when Uncle Mark intervened and took my sister to talk with you aunt Jan and grandma...what happend that day you all came over.....MY MOTHER CRIED! about everything you all put her through for all these years and disowning her! Leave my father alone all-ready and stop your childish bullshit.

  • The KNOX SHERIFF DEPARTMENT spoke to your MOTHER, Tammy. PAUL KNOWS THIS BECAUSE THE SHERIFF sent a car after we left. We did not even see the email that the SHERIFF Dept. took to your father. So tell someone else your lies. You MOTHER gave me permission to get her stuff. Do you think I just feel like wasting my money to play games with your father. Well, I am through playing games.

By Anonymous szainelli, at 7:07 PM, January 28, 2006

  • You mother cried because YOUR FATHER is an asshole and put all those ideas in her head about us hating her. NOW WHO IS HELPING HER? If she hated me so much I don't think she would ask me to help her get her things.

By Anonymous szainelli, at 7:10 PM, January 28, 2006

  • okay so duh, that's what they showed my father. They did not say ONE THING about them talking to her! Henry the Hobo could have showed up and said he talked to my mother too. So it's not lies.

By Anonymous tammy, at 7:11 PM, January 28, 2006

  • i hope you believe your own lies aunt sue. Apparently you have time to sit here and play tit for tat..I don't.

By Anonymous tammy, at 7:15 PM, January 28, 2006

  • Isn't it amazing that there are 2 postings on the Nowakowski Site..... They were made 1 hour after we left their house after being denied Chris' posessions.

ALSO... I personally told Paul Esparza that Chris had spoke to the Sheriff's Dept. The officer who presented Paul with Chris' permission to release her possessions also told this to Paul.

By Anonymous szainelli, at 8:04 PM, January 28, 2006

  • Tammy,
Let me tell you about the day Uncle Mark supposedly intervened.....at MY DAUGHTERS PARTY with her FRIENDS.

That was the day my daughter was supposed to get married and didn't. We had spent alot of money (alot less than today). It was suppose to be "HER"
day. Uncle Mark invited your sister SUZY and it became SUZY'S day. No one told Uncle Mark to invite Suzy because it was my daughters party with her friends. It was my daughters day. Your Uncle Mark brought your sister Suzy their and LEFT HER WITH ME. He was tired and wanted to sleep. So, I was with her until 3 am listening to HER problems. It is great to live 2000 miles away and leave all the problems with me.

By Anonymous szainelli, at 8:31 PM, January 28, 2006

  • Wll it's quite obvious what a loving family you all are. You haden't seen your niece/cousin in God knows how many years, and now you are basically saying you wish you wouldn't have. Did you ever think that maybe...just maybe she wanted a relationship with the side of the family we NEVER knew.

By Anonymous tammy, at 8:55 PM, January 28, 2006

  • and another thing sue.....2 weeks ago you said everyone should leave uncle mark alone because he is very sick, and now you allow your daughter to talk that way about him. What is wrong with you? You should be real proud.

By Anonymous tammy, at 9:15 PM, January 28, 2006

  • Tammy,
Yes, I did ask you all of you to not bother my brother because he is sick. No sooner did I try to post that on your web site he received I don't know how many calls. I AM ALSO SICK. I am the one who is sick here taking care of my 88 year old mother while I have my own health problems. Suzy or you or Dawn were always welcome in my home to come to see or your Grandmother. I did not say that I did not want Suzy at my house. All I am saying is that there was no INTERVENTION as you say. If Suzy came in calmly without accusing MY MOTHER... YOUR GRANDMOTHER of all the problems in her life it would have been fine. Suzy was crying and going to leave my house. If I didn't care about her I would have let her leave. I hugged her and calmed her down. I did not want her leaving in the state she was in. I have maybe said a few things in anger here. I am sorry Tammy. I have nothing against you or Suzy or my brother. I am just a little disappointed that I tried to do something that your mother/my sister had asked me to do today and I was unable to help her. I am not feeling well and I have to take care of Grandma now.

By Anonymous szainelli, at 9:53 PM, January 28, 2006

  • Aunt Sue and I were contacted by my mom to pick up her personal stuff. Yes, we had an e-mail from her and also the police had spoken to her. My cousin also
    was with us. Thanks cuz.

Tammy, mom gave me and Aunt Sue permission to do this. Mom told me
    that herself.Paul did
not want to give us anything.

Uncle Mark promised me he would call Paul and tell him to give us the stuff, thanks for nothing
    Uncle Mark.

Everything Aunt Sue said is TRUE.
Don't assume what mom wants, WE KNOW WHAT SHE WANTS and HOW SHE FEELS!!

Why not end this and give me my mother, (Chris) stuff!

By Anonymous Daughter Dawn, at 11:53 AM, January 29, 2006

  • Dear Tammy,

I want you to know what I remember of our grandfather John before he died. I spent every day with him and he was so proud that he had me, you, Dawn and Suzy as grandchildren. He never said anything bad about anyone. After he died, all I ever heard about from my grandma who I spent every day with till I went to college in 1993 was that she wishes you, Dawn and Tammy would come to see her.

You should have nothing against me, my mother, or grandma, because it is not our fault that we we were separated.

I am proud of myself, and my mother is proud of me. I'm proud of my mother too, for being so strong. Not only does she take care of her mother, while she is sick, but she is trying to help your mom too.

Try not to be so bitter. We love Uncle Mark, but we are very disappointed in his actions.

Dad is going by MOM'S wishes in her letter, she said some nasty things about you in one of the letters, this is not a lie, i have the letter, it is HER handwriting. So why would dad let you and sue take her things based on an email. Again i say the sherriff said NOTHING about speaking to her, and again if they did recieve a call from ma who's to say it really was her? It doesn't take a genius to know that and obviously the sherriff's deparment knows that as well.

MARK.... You talk to people who say this about your MOTHER???????

would just like to say thank you
Chris'BudgetTruckNiece for confirming who the people were that separated us Esparza kids! It was NEVER our mother Dorothy! The Nowakowski family were the only ignorant people who would separate us and caused so many issues between Ma C and your mother Sue. Your Grandmother (Jean) didn't care for any of us that were Dorothys kids and she made it known! You once again made that known to us. So again thank you for confirming that our Mom Dorothy was not the one who did that to us.

By Anonymous GO TO HELL, at 5:12 PM, January 29, 2006

The anonymous comment saying crap about MY MOTHER obviously does not know that she has other grandchildren that were not listed in addition to the ESPARZA KIDS.
Frank, Gina, Nick, John, Alex... HELLO. So do not even start that shit that your FATHER filled your heads with.

By Anonymous szainelli, at 5:19 PM, January 29, 2006

By Anonymous my grandma knows and loves all 10 of you, at 6:37 PM, January 29, 2006

  • I was just trying to let Tammy know something and people on this site take things the wrong way. I don't have Tammy's email address so I can't tell her what I feel directly. Basically, I just remember that the pictures she and her sisters gave to my grandma and grandpa were up in their living room and they used to tell me about them (Suzy, Dawn and Tammy). I didn't hear about Dorothy's kids because I guess they never gave my grandma pictures.

Also I did get a chance to spend childhood days with some of Dorothy's nieces, Dawn and Tracey and we have been trying to keep in touch all these years. We used to go roller skating together and have sleepovers.

If you all want to fight then go ahead, but this is the last message I am posting.

    Take care everyone.............

    By Anonymous Chris'BudgetTruckNiece, at 6:59 PM, January 29, 2006

  • I know I said I wasn't posting anything else, but this is definitely the last message.

I don't understand all the HATRED that is going back and forth here...but I HATE that you blame our grandparents for something, because they had nothing to do with any of the problems that are going on right now.

My grandmother hasn't left the house in years...let's not forget that she doesn't have a jaw-bone. Maybe she didn't go out of her way to visit anyone because she can't drive, can't tell directions, and maybe is a little self-conscious. Have some COMPASSION for her. Show her some love for once.

That is all I have to say to all of you that want to keep blaming her for your problems.

    By Anonymous Chris'BudgetTruckNiece, at 7:14 PM, January 29, 2006

  • And yes, I said MY GRANDMOTHER, because out of all of you posting, who has gone shopping for her in the last week? Since she doesn't leave the house, someone has to go out and get her the odds and ends she needs. Who buys her things that make her happy? Every time I go to Target, I pick up puzzle books, cookies, candy, pens, thread, notebooks, books, socks...whatever she needs. Do any of you so-called grandchildren ever bother to do a damned thing to make her smile?

If i didn't care about ma's things, would i have made sure they got to Indiana? Last, if you are insinuating that i should feel sorry for myself or miserable with my life because i have a handicapped son, then you are sadly mistaken. My son is the best thing that has ever happened to me because the little things, the very small things that we take for granted everyday, mean the entire world to him! To see the joy on his face with even the smallest task completed is priceless. So do me a favor lisa, do not call me or e-mail me and pretend to be concerned about my son. I do not need this crap, and it really breaks my heart.

By Anonymous tammy, at 12:24 AM, January 30, 2006

  • This whole website makes me sick, you all should be disgusted at yourselves. You all are family no matter which way you look at it. But the hatred everyone has here is unbelievable. everyday I wonder what I can do to raise my daughter to be a better person than some of my own flesh and blood. If anything set an example for your children. Do you want this hatred and bickering to continue on for another generation? Its rediculous already, no one is gonna win here. Don't you all understand that this website doesn't benefit anyone either side? If anything look at what the stress of it has done to our uncle mark.
All I have to say is, If grandma wants her things, she will contact someone within the household to get them, or she will write a letter and sign it stating that she wants someone to pick up her things. Trust me I know my grandma, don't forget she raised me. She is a smart woman and knows what she has to do to get her things, if she really wanted you all to pick up her things then how hard is it to get her to SIGN a letter saying that? Or have her get a court order. Its really very simple. Secondly I know that Uncle Mark is the only family member she would EVER ask to pick up her things. I also read her letters I wish we could post them in a newspaper so everyone can see how she felt about those who came to pick up her things, and see why it was not beleived to be true by my grandfather. and if this is true as you all say, why wasn't the sheriff even able to prove it? If he talked to her like you say, why didn't he tell my grandpa he talked to her? And if he had proof why didn't you all leave with her things? Its as simple as that. Give REAL proof. Get stuff. Not hard if you are telling the truth.

    Dear Chris,
I received a card today, on the front was a watering pot. I appreciate what was inside, but I don't understand what you are trying to tell me. If you are concerned about that case, its a dead issue. I will be posting comments to YOU on the nowakowski dissapearance site, because this is a political site and I will only be talking about politics on here.My promise to you is that Moore will not be successful in his committeeman race. As hard as I worked on his first committeeman race I will work twice as hard to make sure he doesn't return to that office. Because he's done everything in his power to hurt our family. I'd appreciate it Chris if your family (especially) Sue would not get involved, with her constant negative comments about me and you. You are and always will be an Esparza. She constantly tries to divide the Nowakowski and Esparza families.
You know that i've never done that. So I will be busy for the next 6 weeks working very hard to be successful on the March elections. I love you very much, and I always will. I know you love me, just by what you have been doing. I recieved the cards and also what you sent direct. Life is strange, but I want you to understand that its very difficult for all of us to be here on the farm because all we have are GOOD memories of you. I put the farm up for sale because I feel if you want no part of it neither do we. Everywhere we look we see you. But my promise to you is that everyone who hurt you politically will regret attacking you . My mission in life has always been to make you happy.I don't care what anyone has to say about you. But you know how I am when I get involved in politics I give 110% to be successful. If you wish to keep the farm you have to let me know, I've done everything you asked me to. So Chris either call me or tell me what to do. I Love you Dearly and You'll always be my Sweetheart!
    You are My True Love

  • Chris My Love,

I'd like to let you know that all of our friends came though for us. They worked very hard and quietly put the word out not to vote for Gene Moore and to support Karen Yarbrough. They were successful in getting Yarbrough the 4,000 votes she needed. Moore has done everything to hurt our family, and because of that, he is no longer the committeeman of Proviso Township. I promised you 4 years ago this would happen, and I make this promise to you now; The wheel will turn full circle next year. For everyone that was involved with hurting our family with their lies and fabricated stories; it will all end in the next primary election. I've been meeting with all our friends downtown and they are very supportive of our family, and are very disappointed in the path that Moore and his cohorts have chosen, by turning the political arena into his own personal vendetta. Everything is okay,
It's time to plant your garden, Spring is here.

    All My Love,
