DEFAM, The verdict: It’s a Mistake [Esparza]

The Esparza v. Moore trial ended in a mistrial. Earlier entry one and two.

Some unauthorized documents were mixed into the evidence the jury was given to examine. According to Bob Habib, Esparza’s attorney, the documents were his. He speculated that after the judge and attorneys agreed on the documents to give the jury the documents were set on the mantle while the attorneys waited for a page of the jury instructions to be delivered. When the pile was given to the deputy it included an extra folder that was probably next to the authorized documents on the mantle.

The indications are that the jury was much more sympathetic with Esparza than the defense. The jury foreman spoke to the junior defense attorney. He chastised her in a sharp tone of voice. He told her a few times that the defense attorneys would “parse words and insult the jury’s intelligence”.

Later Sue Esparza, a daughter of Paul, said the foreman told her that the jury was unanimous as to defendants Moore and Sharp. They were not in agreement on Abdullah. Abdullah who was only linked to the flyer by his post office box number and the fact he did communications work for Moore on the campaign in question.

I was tempted to speculate that Eugene Moore had once again avoided the consequences of his actions. But it seems likely that the trial will happen before the March 21 primary. If it does, Moore will have to take another two weeks out of his schedule to be in court.

State Farm, Moore’s insurer, would seem to be the big loser. I expect the attorney to bill for another 60 hours (at least). At $180 per hour (the Chris Welch rate) that’s another $10,800 on an effort that is probably going to lose.

Unfortunately for State Farm they are insuring a client who would rather lose and say the jury got it wrong than he would to admit to any wrongdoing.

  • IMO it was an honest mistake.

    Without any intel on how the jury saw the situation, it's not obvious who would benefit from a mistrial.

    A mistrial isn't exactly a good deal for Moore. He'll have to take two weeks out of his life to do it again, probably before the primary.

    That was the day my daughter was supposed to get married and didn't. We had spent alot of money (alot less than today). It was suppose to be "HER"
    day. Uncle Mark invited your sister SUZY and it became SUZY'S day. No one told Uncle Mark to invite Suzy because it was my daughters party with her friends. It was my daughters day. Your Uncle Mark brought your sister Suzy their and LEFT HER WITH ME. He was tired and wanted to sleep. So, I was with her until 3 am listening to HER problems. It is great to live 2000 miles away and leave all the problems with me.

    I want you to know what I remember of our grandfather John before he died. I spent every day with him and he was so proud that he had me, you, Dawn and Suzy as grandchildren. He never said anything bad about anyone. After he died, all I ever heard about from my grandma who I spent every day with till I went to college in 1993 was that she wishes you, Dawn and Tammy would come to see her.

    You should have nothing against me, my mother, or grandma, because it is not our fault that we we were separated.

    I am proud of myself, and my mother is proud of me. I'm proud of my mother too, for being so strong. Not only does she take care of her mother, while she is sick, but she is trying to help your mom too.

    Try not to be so bitter. We love Uncle Mark, but we are very disappointed in his actions.

Dad is going by MOM'S wishes in her letter, she said some nasty things about you in one of the letters, this is not a lie, i have the letter, it is HER handwriting. So why would dad let you and sue take her things based on an email. Again i say the sherriff said NOTHING about speaking to her, and again if they did recieve a call from ma who's to say it really was her? It doesn't take a genius to know that and obviously the sherriff's deparment knows that as well.

  • I was just trying to let Tammy know something and people on this site take things the wrong way. I don't have Tammy's email address so I can't tell her what I feel directly. Basically, I just remember that the pictures she and her sisters gave to my grandma and grandpa were up in their living room and they used to tell me about them (Suzy, Dawn and Tammy). I didn't hear about Dorothy's kids because I guess they never gave my grandma pictures.

    Also I did get a chance to spend childhood days with some of Dorothy's nieces, Dawn and Tracey and we have been trying to keep in touch all these years. We used to go roller skating together and have sleepovers.

    If you all want to fight then go ahead, but this is the last message I am posting.

    I don't understand all the HATRED that is going back and forth here...but I HATE that you blame our grandparents for something, because they had nothing to do with any of the problems that are going on right now.

    My grandmother hasn't left the house in years...let's not forget that she doesn't have a jaw-bone. Maybe she didn't go out of her way to visit anyone because she can't drive, can't tell directions, and maybe is a little self-conscious. Have some COMPASSION for her. Show her some love for once.

    All I have to say is, If grandma wants her things, she will contact someone within the household to get them, or she will write a letter and sign it stating that she wants someone to pick up her things. Trust me I know my grandma, don't forget she raised me. She is a smart woman and knows what she has to do to get her things, if she really wanted you all to pick up her things then how hard is it to get her to SIGN a letter saying that? Or have her get a court order. Its really very simple. Secondly I know that Uncle Mark is the only family member she would EVER ask to pick up her things. I also read her letters I wish we could post them in a newspaper so everyone can see how she felt about those who came to pick up her things, and see why it was not beleived to be true by my grandfather. and if this is true as you all say, why wasn't the sheriff even able to prove it? If he talked to her like you say, why didn't he tell my grandpa he talked to her? And if he had proof why didn't you all leave with her things? Its as simple as that. Give REAL proof. Get stuff. Not hard if you are telling the truth.

    I'd like to let you know that all of our friends came though for us. They worked very hard and quietly put the word out not to vote for Gene Moore and to support Karen Yarbrough. They were successful in getting Yarbrough the 4,000 votes she needed. Moore has done everything to hurt our family, and because of that, he is no longer the committeeman of Proviso Township. I promised you 4 years ago this would happen, and I make this promise to you now; The wheel will turn full circle next year. For everyone that was involved with hurting our family with their lies and fabricated stories; it will all end in the next primary election. I've been meeting with all our friends downtown and they are very supportive of our family, and are very disappointed in the path that Moore and his cohorts have chosen, by turning the political arena into his own personal vendetta.
