LAWSUIT, new filings in Steinbach v. Forest Park [FP]
Forest Park Commissioner Terry Steinbach, a candidate for mayor, has filed a lawsuit against the Village of Forest Park and Forest Park employees for accessing her commissioner email account and sending emails to Mayor Anthony Calderone, a political rival.
Steinbach noticed that emails in her "sent folder" were forwarded to Calderone. She didn't do it. She assumed that Forest Park employees were the ones with motive and opportunity.
After naming three John Does as defendants Steinbach has named one of these people, Craig Lundt, the village employee who supervises information technology. See Forest Park Review (Josh Adams).
Lundt says he didn't do it. I've heard rumors that the village is pretty casual about protecting passwords, including Lundt's password. If someone had access to Lundt's account--say an employee who is a political partisan--it's possible this individual could have use Lundt's administrator account to access Steinbach's emails.
The village is claiming that the privacy policy protects the village from lawsuits.
This argument strikes me as bullshit. If one accepts this position the political majority (Calderone, Gillian and Hosty) would have complete access to the communications of the minority. And something tells me that the minority (Doolin and Steinbach) or citizens will not have equivalent access to emails of the majority.
But we'll see what the courts rule. Or maybe the case will get dropped after the election.

The village's policy on municipally-maintained e-mail accounts clearly outlines that there is no expectation of privacy. However, the village clerk confirmed in November 2006 that there is no record of Steinbach receiving a copy of this policy....
"Forest Park denies that any e-mail communication sent to, from, or within the Forest Park e-mail system is private," defense attorney Matthew Iverson said in court documents.

The timing of this lawsuit is just too convenient. My guess is that it will be dropped after the election when she isn't trying to get her name out there.
At this point there is no proof other than her word that this was done. There are plenty of ways to get someone's password without being an IT person, so the naming of Craig Lundt is totally bogus.

Assume Steinbach has her facts straight, is it unreasonable for her to sue the village if an employee did access her account and forwarded emails to Mayor Calderone?

Assume Nyberg is a pedophile. Is it wrong for a pedophile to hold office. It is wrong to assume the worst when a liar makes an allegation without any facts to back it up. Stop with the nonsense. Stop spreading lies just to have something to talk about.
Why should anyone assume what Steinbach says is true? She is a pathological liar. This is all political b.s. from Steinbach in a desperate attempt to smear the innocent to get office. Who could ever trust someone like Steinbach?

Steinbach and her attorneys claim to have a good faith basis for the suit.
The village hasn't denied the key facts of Steinbach's allegations, has it?
The village's legal defense isn't premised on Steinbach being wrong about the facts. Instead the village is basing its defense on Steinbach being wrong about the law.
Given the village's legal argument, it seems reasonable to ask the hypothetical, if Steinbach is correct about the facts, did village employees behave in an inappropriate manner?
If your side was in the minority would you want the majority having village employees snooping through your commissioners email accounts?

The "it's wrong to sue the village" argument is bullshit.
If you're in the minority and the majority uses the power of the municipality, school district, county, etc. against you in an illegal manner, you pursue a civil action against the body that wronged you.
The Village of Forest Park clearly has cognizance over the acts against Steinbach.
If you need this explained further, go ask Mike Sturino or some other attorney.

If she did was she denied any information?
What were these alledged e-mails?
Are these e-mails private?

This still smells like bull stuff. Steinbach has a track record of stirring up trouble just to get attention, or to make people alarmed over what turns out to be nothing. There's nothing to this latest Steinbach claim - and it's all going to go away after the election. Bet on it.
Too bad Steinbach is such a sneaky liar and so ready to spread innuendoes and dirty politics. The Village deserves better.

To answer can't believe:
Did she bring it to the villages attention first: Yes
Was she denied anything? Yes
What were these alleged Emails? Don't know. Ask Calderone. He saw them first.
Are they private? Yes.
Made up? No. Even the village is admitting that it happened.
Password secret? It has nothing to do with passwords.
