Welch brothers file suit against Nyberg

On August 25, 2005, I filed a complaint against Emanuel "Chris" Welch with the Attorney Registration and Disciplinary Commission.

Today I received Welch's response to the ARDC.

Included in the response are two suits filed against me in the Circuit Court of Cook County.

4. Throughout NYBERG'S postings on his web blog [sic], NYBERG repeatedly attacks Plaintiff's [sic] WELCH'S character and integrity, calling him a "liar" and insinuating he associates with corrupt individuals in the posting entitled "Ethics Complaint Filed Against Mark Sterk." Defendant NYBERG further insinuates that WELCH is comfortable with illegal activity in "Trib Covers EMM," that he is an unethical attorney in "Open Questions for Chris Welch," and in "Nyberg Files Complaint Against Welch" and that he engages in nepotism in "My Two Cents on Billy W. Welch."...

5. Plaintiff WELCH understands that Defendant NYBERG is entitled to his opinion, however, consistent with this pattern of harassment, on August 30, 2005, Mr. NYBERG moved beyond his web blog [sic] and maliciously wrote a false and defamatory letter to Plaintiff WELCH'S boss, Mr. James J. Roche.

6. The letter was delivered to Mr. James J. Roche, read by him and states that WELCH "is using his position as president of the District 209 board to build a political organization to the detriment of Proviso Township High Schools and taxpayers."

7. NYBERG goes on to say in the August 30th letter that Plaintiff WELCH is "actively looting the district," and that WELCH violates attorney ethics standards "when it suits his personal loyalties and ambitions."


Then there's some legalese and it wraps with:

WHEREFORE, Plaintiff, WELCH, prays his Honorable Court to enter judgment on Count I in his favor and against the Defendant, NYBERG for compensatory damages in excess of $1,000,000.00, together with punitive damages and his cost of suit.

Bill Welch v. Carl Nyberg

4. On or about August 24, 2005, Defendant NYBERG published on his web blog [sic] an article written by him, entitled, in bold letters, "Billy Welch Indicted for Drug Dealing."

5. This web blog posting re-creates an arrest report for Billy Welch.

6. After re-creating the arrest report, Defendant NYBERG then adds, in his own words, "Both Marco Thomas and Welch were indicted on charges of possession of a controlled substance with intent to deliver."

7. Not only was Plaintiff WELCH shortly thereafter cleared of all wrongdoing in association with this arrest report, he was never indicted....

WHEREFORE, Plaintiff, WELCH, prays this Honorable Court to enter judgment on Count I in his favor and against the Defendant, NYBERG, for compensatory damages in excess of $1,000,000.00, together with punitive damages and his costs of suit.

  • Typical of Welch to sue anyone who is telling the truth about his criminal organization! Is there not a law that states that frivious law suits are punishable!Mr. Welch believes he can stop free speech, but he will lose! Talk to Peraica or Frank Avila , I'm sure they will represent you on this for free, and make Welch pay for your fees!

  • Carl, you need to talk to the media and get them on your side, because of Welch's assault on Free Speech! Talk to the ACLU, get on the radio, Carles Flowers show and Arnie Bryant's show, talk to the pioneer press, expose Mr. Welch, who now has achieved for his opponents what they have sought, which is a public trial on him and his misconduct! The entire lid of Welch's corruption will be opened up at your trial and exposed, thanks to Mr.Welch!

  • This is not good Carl. There's a precedent of Judges in northern Illinois being sympathetic to public officials. As if this was the 1950s. A dismissal or settlement offer would save years of headache.

  • Jared has no idea what he's talking about - and likely a Welch/Moore supporter since he's trying to psyche you out, Carl. This is a case that should be quickly dismissed in Nyberg's favor. I'd agree that if properly played in the media and in the court house, this can end Welch's political career. Also saw a aood post on this subject on capfax blog comments.

  • I love this. A win in this case could result in blogs being given the same protection that the press gets. Bloggers need to be able to shield sources and speak their minds freely. First ammendment baby. Or a loss could have the opposite effect and everything remains the status quo.
    Get a lawyer now! Call the ACLU, EFF, NPR. Stop the presses!

  • I almost feel sorry for Chris, but I don't since being an attorney, who has voluntarily chosen to enter the political field, he, better than 99% of the population, should have a little thicker skin. In 26 years of elective office I have been called just about everything imaginable BUT, I have never thought to take any action EXCEPT, when a man would continually call after midnight and wake my wife and I up. No, freedom of speech does not cover a silent call in the middle of the night! We caught him with police help. Chris showed me a face I never dreamed he would have at a non-partisan 209 election forum in Maywood. Granted he faced lots of hostile questions but he was the only member of the 209 majority running, and there, so he had to expect that. What does he do after a hostile questioner (I remember about 4 questions rolled up into one with two of them not very nice), just what he is trying to do here to Nyberg, he ranted to the audience that he demanded that the sponsors give him the questioner's name so he could file a lawsuit. Being brighter than Gene Moore only seems to mean that he been building a deeper grave, I hope. By the way, all the asides about who he has dated seems to be in rather poor taste!

  • Carl, you're not a dick for publishing your opinions and other information for public consumption. (Even if you WERE wrong about Billy Welch being indicted, inaccuracy is not evidence of malice.) Everyone should know that a school district employee was riding in a vehicle with a whole lot of controlled substance and the guy to whom it belonged, this guy presumbly works in proximity to students. What does Marco Thomas think about Billy Welch getting off scot-free? I wonder if he thinks Welch finked on him?

  • I have a photocopy of the indictment of Billy Welch. I don't know what Chris Welch is thinking in this suit.

    Is it in Billy Welch's best interest to be deposed about his involvement with drugs and drug dealers?

    Billy might want to consider another vacation to the family safe house in Michigan.

    Getting sued is "no fun," but I see it as evidence that I'm making progress at exposing the underhanded stuff being done in Proviso Township.

    Media journalists print corrections (sometimes)but are rarely sued for their mistakes or even gross misstatements that go unaddressed.

    Obviously you are being muscled.
    The plaintiff in your case doesn't have the skin for elective office and is resorting to coercion to get you to stop exposing his antics. The plaintiff has the public eye and the forum to correct any misinformation without resorting to a lawsuit.

    It was just over a couple of hundred years ago when some of our founding fathers adopted pen names to expound on justice and legitimate government. If Ben Franklin were alive today, he'd be blogging away!

  • This the same stuff that happened to Frank Coconate and Patrick McDonough. I agree with a suggestion to use Frank Avila. Frank in court will rip the flesh off the crooks. It is magic to watch his court presence. Sure beats losing your money for talking up. "Deep Water"

Welch would kill his own mother if she tried to hurt his poltical career.Welch has turned on Therese Kelly, Pasquale, now he has turned on Serpico. He will soon turn on Moore and later on Bruno!
